Description

Offences against government services are acts that interfere with, cause harm to, or otherwise negatively impact government services or structures, other than relating to government security. This includes offences against any level of government, and government statutory agencies or agencies that operate under government regulation.

1521 Resist or hinder a government representative

Government representatives refer to any employee undertaking their role within any level of government, excluding police, justice officials, defence force or government security officers. 

This may include customs officials, emergency services workers, government service providers, and compliance officers employed by government such as parking inspectors, food safety inspectors, workplace safety inspectors, and others. It does not include workers outside the public sector.

This group excludes assault, bribery, and fraud.

Inclusions:

  • Intentionally block, hinder, or otherwise prevent a government representative from undertaking a task or action required for their job
  • Physically resist a government representative undertaking their job
  • Prevent a government representative from entering or leaving their workplace or other location
  • Refuse to follow directions of customs officials, emergency services workers, or other government representatives
  • Other acts that hinder a government representative in the course of their work not elsewhere classified

Exclusions:

  • Assault – coded to the relevant groups within 02 Assault
  • Bribery of a government representative – coded to 0831 Bribery involving a government official
  • Resist arrest – coded to 1422 Resist or hinder a police officer or justice official
  • Resist or hinder a member of the Australian or New Zealand defence forces – coded to 1519 Offences against national security, nec

1522 Migration offences

Migration offences include visa offences, unlawful entry into Australia or New Zealand, and aiding unlawful entry. It excludes human trafficking offences.

Inclusions:

  • Breach visa conditions
  • Leave the country while owing child support
  • People smuggling
  • Unlawful immigration
  • Unlawfully leaving the country where no other offence has occurred
  • Unlawfully remove a child from the country, where the act does not constitute abduction or kidnapping
  • Other migration offences

Exclusions:

  • Forge a passport or visa – coded to 1519 Offences against national security, nec
  • Human trafficking – coded to 0410 Human trafficking or slavery
  • Registered sex offender travelling overseas – coded to 1443 Breach of sex offender requirements

1523 Voting or electoral offences

This group includes offences related to elections and voting.

Inclusions:

  • Breach regulations relating to voting or elections
  • Fail to register to vote in New Zealand
  • Fail to vote in an Australian local, state, territory, or national election
  • Illegal voter registration
  • Intentional miscounting of votes
  • Interference with voting or electoral processes
  • Political fraud
  • Provide false information to an election official
  • Tampering with votes
  • Theft of ballots
  • Other voting or electoral offences

Exclusions:

  • Use of fraudulent documentation to vote – coded to the relevant group within 081 Obtain benefit by deception

1529 Offences against government services, nec

This group is for other offences against government services that are not elsewhere classified.

Inclusions:

  • Fail to return census form or other legally required surveys or forms
  • Hoax calls to emergency services
  • Interference with postal services
  • Refusal by a public officer to perform a duty
  • Other offences against government services not elsewhere classified

Exclusions:

  • Intentionally provide false information to a government agency (excluding police or in court) – coded to the relevant group in 081 Obtain benefit by deception
  • Tax fraud – coded to 0813 Tax offences
  • Theft of electricity, gas, water, internet, or other utilities – coded to 0799 Theft, nec
